This is a motion to revive a dormant judgment, in which' a jury trial was waived, and, by consent of both parties, his Honor found the facts and declared the law, as follows:
This is a motion to revive a dormant judgment rendered and docketed in 1892 in favor of the plaintiff against Eugene Johnson, D. A. Swink and Geo. T. Thomason, defendants. Josephine A. Thomason is administratrix for the latter— and the motion is for leave to> issue execution thereon.
