This is an action of ejectment brought by appellants, as heirs of Benjamin Watts, deceased, for the recovery of land sold by Wm. O. Boon, under authority of a special act. Boon failed to account for the proceeds of the sale, and his sureties were sought to be charged in The State, to the use of Watts, etc., v. Boon, reported in 44 Mo. 254. The facts being there recited, it is unnecessary to recapitulate them, and we have only now to inquire whether Boon so complied with the requirements of the act that his sale and conveyance passed the title. ‘ «
