This action was brought against the plaintiff in certiorari, who is a married woman living with her husband. The husband was not joined as a defendant in the suit. The claim of the plaintiff below was upon an open account for goods sold and delivered, commencing May, 1874, *456and covering a period extending down to July 21st, 1875. Payments had been made on account from time to time, leaving a balance due of $45.99, for which judgment was rendered, with costs.
