PIERCE, Judge.

This is an appeal by appellant Seaboard Finance Company, a Delaware corporation, from a summary final judgment entered against appellant as plaintiff below and in favor of appellees Mutual Bankers Corporation, a Delaware corporation, and W. N. Saunders, defendants below, in a suit brought to recover damages in the sum of $90,000.00 alleged to be due pursuant to a previous written agreement between the parties relating to the sale by defendants to the plaintiff of majority stock holdings in a third corporation, Union Finance Corporation.
