This is the second appearance of the case before the court. The judgment of the district court therein was reversed on the former hearing. (National Masonic Accident Ass’n v. Burr, 44 Neb. 256.) On a new trial in the court below the plaintiff again obtained a judgment, which the defendant by this proceeding seeks to reverse-. A full statement of the facts need not be now given, as they may be found in the former report of the case.
