Roy Dale Chatterton was found guilty of murder by a jury in Chattooga Superior Court on January 23, 1965, and sentenced to death. The order overruling his motion for a new trial was affirmed by this court on October 7, 1965. Chatterton v. State, 221 Ga. 424 (144 SE2d 726). The Supreme Court of the United States refused to review the case (384 U. S. 1015). On October 24, 1966, Chatterton was again sentenced to death, and on November 9, 1966, he filed his petition for writ of habeas corpus in the City Court of Reidsville asserting he was being illegally restrained of…
