he defendants here were plaintiffs below, and brought this ejectment for one undivided half of a tract of land containing two hundred acres.

At the trial, the plaintiffs claimed one-sixt.h part of the land ; and for so much they had a verdict and judgment. . ,

Both parties assumed that the whole tract was, atone time, the property of Samuel S. Galbraith. By his first wife he had two sons, Bartram and James. James died in 1823, unmarried and without issue. After the death of his first wife, Samuel married Juliet Buchanan, who died, leaving one…
