Upon consideration of motion for rehearing the opinion heretofore filed is withdrawn and the following substituted therefor:

In a case filed in the Small Claims Court of Bernalillo County, plaintiff-appellant sought damages for defendant-appellee’s alleged negligence whereby plaintiff suffered loss through water entering premises leased by plaintiff from defendant.
