*581In an action to recover damages for medical malpractice, etc., the plaintiffs appeal from a judgment of the Supreme Court, Queens County (LeVine, J.), dated October 16, 2003, which, upon an order of the same court dated October 25, 2002, inter alia, granting that branch of the defendant’s motion which was to dismiss the complaint and denying their cross motion, in effect, to vacate their default in complying with certain conditions of a prior order of the same court dated May 7, 2002, dismissed the complaint.

Ordered that the judgment is affirmed, with costs.
