This was a proceeding by appellant against the appellee to foreclose and enforce a lien for street improvements.

Upon petition of the requisite number of property owners, the board of trustees of the town of Browns-town, in Jackson county, ordered the improvement of a certain part of Broadway street within the corporate limits of said town.
