| TA jury convicted the defendant, Kenneth Wayne Montgomery, of two counts of distribution of cocaine, violations of La. R.S. 40:967. After sentencing, the State of Louisiana (state) charged him in a separate proceeding as a habitual offender, a violation of La.R.S. 15:529.1. The trial court adjudicated the defendant as a second-felony offender after considering the evidence presented at the hearing on the habitual-offender issue.
