Appeal from an order of the Supreme Court (Conway, J.), entered July 29, 1992 in Albany County, which granted a motion by defendant Carm’s Place, Inc. for summary judgment dismissing the complaint against it.
On December 18, 1988 at approximately 6:30 a.m., a pickup truck driven by defendant Thomas H. McLaughlin collided with an automobile being driven by plaintiff.
