KOELTL, District Judge.

New York State prisoner Michael Graham, the petitioner, who is currently incarcerated at the Marcy Correctional Facility in Marcy, New York, brings this pro se petition for habeas corpus pursuant to 28 U.S.C. § 2254. After a jury trial, the petitioner was convicted of one count of criminal sale of a controlled substance in the third degree and sentenced to an indeterminate term of imprisonment of five to ten years.
