This case is before us on a writ of certiorari directed to the judge of the Court of Common Pleas for the county of Monmouth, and William S. Holmes. The writ brings up the conviction of the prosecutor, William T. Newbury, at a .trial de novo in the Monmouth County Court of Common Pleas, upon the complaint made against the said William T. Newbury under subdivision 3, section 14, chapter 808 of the laws of 1981. This is 'the section prohibiting any person under the influence of intoxicating liquor * * * from operating any motor vehicle owned by him or in his custody or control.
