This was an action of replevin brought by James N. Ward against James M. Broadwell, for one buggy and one set of harness for two horses. Tlie suit was instituted on tlie twentieth day of June, 1853. The replevin act under wbicb tbis suit was brought was passed by the general assembly of tbe territory of New Mexico, at its December session, 1847. Tbe treaty of Guadalupe Hidalgo was made on tbe second day of February, 1848.
