Appeal by the defendant, George Wing, from an order of the Supreme Court, made at the Erie Trial Term and entered in the office of the clerk of the county of Erie on the 13th day of December, 1899, denying the defendant’s motion to set aside a verdict in favor of the plaintiffs and for a new trial made upon the minutes.

Adams, P. J.:
This action was commenced in the Municipal Court of the city of Buffalo, where judgment was rendered in favor of the plaintiffs. An appeal was thereupon taken to the Supreme Court where another trial was had with the same result.
It appears that the plaintiffs, who are lumber dealers, sold a quantity of lumber to one Edson B. Sawdy, between December 9, 1895, and March 25, 1896. This lumber was delivered to Sawdy upon certain premises in the city of Buffalo, whereon he was erecting two houses, and the bill therefor amounted to the sum of $1,345.91.
