Charlie Carter, plaintiff in error, herein referred to as the defendant, was by information filed in the district court of Stephens county on July 16, 1919, charged with the larceny of a hog, the property of J. C. Forth, on July 11, 1919. On October 8, 1919, a verdict of the jury was rendered, finding the defendant guilty as charged and assessing his punishment at confinement in the state penitentiary for four years. A motion for a new trial was filed and overruled, and judgment was rendered according to the verdict on October 13, 1919. From this judgment defendant appeals.
