Appeal from a judgment of the County Court of Broome County (Mathews, J.), rendered December 3, 1992, upon a verdict convicting defendant of two counts of the crime of criminal sale of a controlled substance in the third degree.

In July 1992, defendant was indicted and charged, in two counts, of criminal sale of a controlled substance in the third degree stemming from allegations that defendant sold cocaine to undercover officers on May 13, 1992 and May 20, 1992.
