The plaintiff is a colored man, about 46 years old, and for several years prior to September 30, 1933, had been' in the employ of the Kansas City Southern Railway Company as a section laborer. This railroad secured from the defendant insurance company a group policy covering its employees, including plaintiff, who was insured in the sum of $1,000, the premium, as is usual in such policies, being paid jointly by the employer and the employee.
