(After stating the foregoing facts.) Special ground 1 of the amended motion for a new trial has been abandoned.
Special ground 2 contends that the court erred in failing to charge the jury “that the burden was upon the State to prove to the jury beyond a reasonable doubt that the articles of money and moneybag alleged to have been found in the automobile of the defendant or the automobile in which he had the keys too [to], were the same articles which is alleged and claimed to have been stolen from the place alleged to have been burglarized.” This charge was hot requested and it is contended…
