Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Saratoga County) to review a determination of respondents which found petitioner guilty of misconduct and suspended him from his employment for one year.
After a hearing, petitioner, a volunteer firefighter in the Jonesville Fire District, was found guilty of misconduct based upon his refusal to participate in sexual harassment training provided by the District.
