— In two actions, the second of which was for a declaration that the defendant State Farm Mutual Automobile Insurance Company is obligated to defend or indemnify Jens Knitter in a wrongful death action arising out of an accident which occurred on April 21,1979, State Farm appeals from so much of an order of the Supreme Court, Orange County (Hawkins, J.), dated September 21, 1981, as granted the plaintiffs’ cross motion for summary judgment in the declaratory judgment action.
