Affirming in part and reversing in part.
Appellant, Chilton, by this litigation sought the settlement of the estate of Martha Gr. Hayden, the assignment of curtesy to' him out of the landed estate of Mrs. Hayden and the recovery on a note of $4,000.00 due, as he averred, from the estate of Mrs. Hayden. The lower court adjudged him entitled to curtesy in the lands of his wife, which was two-ninths of the entire- Hayden tract, and directed that it be laid off to him, and found that the $4,000.00 note sued on was executed by Martha Hayden but without…
