Appeal by the defendant from a judgment of the Supreme Court, Kings County (Del Giudice, J.), rendered February 7, 2011, convicting him of robbery in the first degree, kidnapping in the second degree, and assault in the second degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is modified, on the law, by reducing the defendant’s conviction of assault in the second degree to assault in the third degree, and vacating the sentence imposed thereon; as so modified, the judgment is affirmed, and the matter is remitted to the Supreme Court, Kings County, for further…
