ORDER
SCOTT M. MATHESON, JR., Circuit Judge.
This matter is before the court on appellant’s petition foe rehearing and suggestion for rehearing en banc. The petition is granted for limited purpose of amending the previously filed order. The amended order, filed nunc pro tunc to February 7, 2012, is attached to this order.
The petition for rehearing en banc was transmitted to all of the judges of the court who are in regular active service. As no member of the panel and no judge in regular active service on the court requested that the court be polled, that petition is also denied.
