This case is a petition in error, filed by the Brecks, to reverse the judgment of the court of common pleas on an indictment under which the plaiiitiffs in error were found guilty of forging the will of Martha Hall McDonald, and the judgment of the court below was, that the plaintiffs in error be sentenced to the penitentiary. of the state of Ohio for the term of four years each, and they are each of them in the penitentiary.

The instrument which is charged to be forged, is this:

“Cleveland, Ohio, December 23, 18861 I, Martha Hall McDonald, being this 23d day of December, 1886,…
