The plaintiffs pray an injunction against the collection of an assessment on their lands for the benefit- of the Gravel Road Company, defendant, under the act of May 14, 1869.
Section 1, of that Act, provides that a gravel road company, having a valid and solvent subscription of at least three-fifths of the estimated cost of the construction of its road, &c., may petition the Board of County Commissioners of the proper County to have assessed the amount of benefits to each tract of land within one and one-half miles of such road, on either side thereof, and within a like distance of either end…
