APPEAL from a judgment of the District Court of the First Judicial District in and for the County of Pima. The facts are stated in the opinion.

This action was brought to recover upon a bank cheek alleged to have been given by appellant to respondent on the Guaranty Trust Bank of Philadelphia, about the month of March, 1883. The complaint alleges that the check was presented for payment about April 1, 1883, and that payment was refused by the bank. Appellant being a non-resident, and the complaint alleging that he has property in this territory, the action is brought here. There was no appearance in the court below on the part of the defendant. Judgment was taken by default, and the case is brought here upon the judgment roll.
