MEMORANDUM AND OPINION

CARL O. BUE, Jr., District Judge.

Following completion of the Government’s case, the defendants moved for judgment of acquittal under Fed.R.Crim. P. 29(a) alleging several grounds in support thereof. Of central importance to this Court’s decision was the claim that the indictment failed to charge an offense against the laws of the United States of America, this being a nonwaivable defense under Fed.R.Crim.P. 12(b)(2). In what is apparently a case of first impression in the federal courts, this Court felt constrained to grant defendants’ motion for the reasons set forth…
