It appears from the record that a trial was had in this cause on the 10th day of November, 1881, before George W. Stipp, presiding judge, and a jury. The action was debt, upon an appeal bond. The only plea upon which issue was taken was non est factum. The trial resulted in a verdict and judgment against the defendants,—appellants here. Upon the return of the verdict, November 10, (the day the trial was had,) no motion was entered for a new trial, and the court rendered judgment on the verdict.
