I. Background
This declaratory judgment action was filed by State Farm Fire & Casualty Company (“State Farm”) for declaration of nonliability on a homeowner’s insurance policy issued to defendant Clifford Woods (“Woods”) covering a dwelling in Jasper County, Texas. The parties have consented to conduct all proceedings in this civil action before the undersigned United States Magistrate Judge pursuant to 28 U.S.C. § 636.
