The plaintiff and appellee filed her petition in the district court of Johnson county on the sixteenth day of Jan*253uary, 1882, by which she sought the foreclosure of a mortgage ou certain real estate executed to her by E. Collingwood, by W. Wames, his attorney in fact, on the sixteenth day of January, 1874, for the purpose of securing the payment of a promissory note of the said Collingwood, executed of that date in his name by said attorney in fact, for the sum of $3,000, cbm and payable on the sixteenth day of January, 1877.
