This is an action commenced in the circuit court of Bureau county by the appellee, a minor under the age of fourteen years, by his next friend, against the appellant, to recover damages for a personal injury sustained by him while in the employ of the appellant as a “trapper” in its coal mine. The case was tried upon a declaration containing three counts. The first count charged the appellant with negligence in failing to provide appellee a safe place in which to work.
