Cox sued Martin, alleging, that Martin entered into a contract with him to purchase from him twelve shares of the. capital stock of the Martin Furniture Company at a price not less than $1,500; and that he tendered.the stock to Martin in pursuance of the contract, stating his desire to sell, but that Martin refused to take the stock, and consequently is indebted to him in the sum of $1,500, with interest.
