Affirming.
At the June term, 1910, of the Lee Circuit Court Garfield. Hoskins was indicted for the crime of wilful murder committed by shooting and killing Harrison Hargis. Upon the first three trials of the case the jury failed to agree; upon the fourth trial he was found guilty of manslaughter, and his punishment fixed at confinement in the penitentiary for life.
