[1] Sam L. Mims prosecutes this appeal from an order of seizure and sale, issued at the instance of the plaintiff herein to enforce payment of a note for $14,375, executed by defendant in part payment of the price of certain real estate purporting to have been purchased by him from the Minden Fruit & Truck Company, Limited, which note is dated December 23, 1911, made payable December 23, 1912, to the order of the maker, and by him indorsed in blank, and purports to be secured by mortgage and vendor’s privileges on the property ordered to be seized and sold.
