WOODLEY, Judge.

The conviction is for burglary; the punishment, six years in the penitentiary.

The building housing the Leader Grocery and Hardware Company in Pecos, Texas, was burglarized on the night of January 11, 1953. Eight pistols were missing when the burglary was discovered on the following morning.

Fifteen-year-old Henry Dominguez, hereinafter referred to as Henry, had been adjudged a delinquent and sent to the Gates-ville State School for Boys for his part in the burglary. He testified for the state and the court, in his charge, correctly instructed the jury that he was an accomplice…
