Harry E. Bovay, the defendant, has appealed from a decree rendered against him in the Chancery Court of Shelby County, in the sum of $2458.12 and costs of suit. The decree was entered February 16, 1931.

The complainant, hereinafter called the bank, sued the defendant on his promissory note, which he had executed to one James A. Henderson. It appears that Henderson had died, and that Henderson was, at the time of his death, heavily indebted to the complainant bank. The debt or note sued on was originally the debt of Henderson.
