LINDSAY, J.*

The Board of Education of the Sunnyvale Elementary School District (hereafter District) appeals from the judgment denying its petition for writ of mandate which sought to set aside a split decision of the Commission on Professional Competence of said District (hereafter Commission) reinstating real party in interest Lujan to his teaching position and awarding him costs and attorney’s fees.
