This case is brought to this court from the Appellate Court for the Third District by petition for writ of certiorari to review a judgment of that court affirming a decree of the circuit court of Morgan county.
The lands of Fannie Hills Headen, who died intestate, were sold at partition sale under a decree of the circuit court of Morgan county, and the proceeds .of the sale, after pay-’ ment of costs and expenses, were ordered distributed among her heirs, eight in number.
