The appellant, Daniel C. Montano, and Yvonne Jimenez were accused by an information of the crime of possession of heroin in violation of section 11500 of the Health and Safety Code. The appellant duly waived his right to trial by jury. He was found guilty and, his motion for a new trial having been denied, he was sentenced to imprisonment in the state prison for the term prescribed by law. He appeals from the judgment and from the denial of his motion for a new trial.
