KING, Circuit Judge:

Fletcher Thomas Mann appeals from the district court’s denial of his habeas corpus petition. As we find that Mann failed to file timely notice of appeal from the judgment, we are compelled to dismiss the appeal.

Fletcher Thomas Mann (“Mann”) is a state prisoner currently incarcerated by the Texas Department of Corrections. Mann was convicted of the capital murder of Christopher Lee Bates and was sentenced to death. The facts surrounding the commission of the crime are recited in detail in Mann v.
