Defendant was convicted after a trial by jury of driving while under the influence of intoxicating liquor (DUI) *590in violation of 23 V.S.A. § 1201(a) (2), and subsequently filed a timely notice of appeal. We affirm.

At approximately 11:15 p.m. on October 21, 1980, defendant and a companion left the scene of an all day strike protest at the Waterbury Plastics Plant in defendant’s van.
