This is an original proceeding in prohibition wherein the relator seeks to prohibit the Hon. E. E. Porterfield, one of the judges of the circuit court of Jackson county, Missouri, from tailing further cognizance of the ease of Merchants Bank v. Whaley, therein pending. A preliminary writ was issued and the case now comes upon the question of making it permanent.
