This is an action of tort at common law, for personal injuries sustained by the plaintiff while in the defendant’s employ. The room in which he worked was a large one, and in it were many machines for grinding rags in the process of making rubber. These machines were in rows extending the length of the room. Between the rows were passageways several feet wide, and at intervals of every two machines were cross passageways about three feet wide. Each row of machines was operated by a long shaft extending the length of the row. There was also a water-pipe which extended the length of each row…
