In an action to foreclose a mortgage, the defendant Gregory Karpinski appeals, as limited by his brief, from so much of an *959order of the Supreme Court, Kings County (Saitta, J.), dated April 16, 2008, as granted those branches of the plaintiffs motion which were for summary judgment dismissing the first and fifth counterclaims asserted by him and so much of the second and third counterclaims asserted by him as sought to recover prepayment penalties.
