Appeal by the plaintiff, Charles Pecue, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of Washington on the 17th day of September, 1919, upon the dismissal of the complaint by direction of the court at the close of plaintiff's case.

Cochrane, J.:

This is an action for libel. The New York Civic League is a corporation. Included in its activities, which are presumably within its corporate powers, is the collection of information concerning the commission of crimes and the conveyance of such information to the proper authorities for the purpose of investigation. The defendant is the superintendent of the law and order department of said league. Two letters were written at about the same time by the same person, one to the defendant and another to a person who has not been shown to have any relation to the league but which…
