The state of Kansas, upon the relation of F. A. Meckel, as county attorney of_ Chase county, sought by this action to restrain and enjoin the defendants, who together constitute the board of *67directors of union school district No. 4, of Chase county, from proceeding with the erection of a school building for the use of that district. This order was denied by the district court, and the plaintiff seeks a reversal of that action.
