Memorandum and Order

This matter is before the Court upon the cross motions of the defendants for summary judgment pursuant to Rule 56, Federal Rules of Civil Procedure.

This is an interpleader action which was removed from the Circuit Court of Audrian County, Missouri. The inter-pleaded fund in the amount of $8,222.95 is the balance resulting from a Contract between the plaintiff Housing Authority of the City of Mexico, Missouri, (herein Authority) and the Contractor, Plez Lewis & Son, Inc.
