On April 25, 1902, the defendant Moore entered into a contract with the plaintiffs Newland and Williamson and one Lars J. Jensen for the sale of a certain farm, together with livestock and farm implements thereon, situate in the *752county of Blaine, for the sum of $2,050, and on that date the purchasers paid the sum of $1,000, and the defendant executed a deed to the property and placed the same in the First National Bank at Hailey, in escrow.
